Лев Николаевич продолжает работу над статьей «Революция неизбежна», переименованной 17 мая в «Неизбежный шаг», а 19 мая— в «Неизбежный переворот».

Написан диалог «О собственности» к серии «Детская мудрость».

3, 5—7, 9 мая продолжается работа над статьей о «Вехах».

Чтение «от доски до доски» в «Вестнике Европы» (№ 5) «Записок английского судьи», сторонника современных смертных казней, о смертных приговорах в прошлом веке.
4 мая Чтение Конфуция и Лао-Тзе и обдумывание народных книжек об этих мыслителях. Чтение «милого» дневника школьных занятий 3. М. Гагиной. Дневник был напечатан под псевдонимом Н.Б. Петрова под заглавием Из дневника народной учительницы .
5 мая Толстой написал благодарное письмо польскому художнику Яну Стыке за присланную репродукцию со своей картины «Толстой за работой в саду, окруженный призраками бедствий, которые терзают его родину». Снимки с этой картины были вопроизведены на открытках и во многих журналах с подписью «Толстой, пишущий «Не могу молчать».
Л.Н. Прочитал в «Новом времени» заметку о том, что в Духовной академии будет прочитана диссертация об Иоанне Эфесском и что его взгляды схожи со взглядами Толстого.

О вере: Соловьевское, булгаковское православие — не то: оно искусственное и неискреннее.

6 мая. Чтение «ругательной» резкой брошюры И. Восторгова «Знамения времени. Отец Иоанн Кронштадтский и граф Лев Толстой». М., 1909.
7, 9 мая Чтение повести Куприна «Яма». «Очень плохо, грубо, ненужно грязно... Но любуюсь его художественным талантом: придумывает каждому лицу характерные черты».
9—13 мая Работа над статьей «О любви».
9 мая. По поводу окончательного запрета В.Г. Черткову жить в Тульской губернии, Толстой сказал: «Я сначала почувствовал прямо недоброе чувство к Столыпину, а потом мне стало жалко его... Какую память он себе готовит в истории? Все с отвращением будут поминать его».

10, 12 мая Исправление заметки «О государстве», продиктованной 26 февраля. Позже под заглавием «О государстве» статья напечатана в 38 томе ПСС.
11 мая. Письмо по поводу внесенного в Государственную думу законопроекта о свободе совести. Толстой смотрит «на людей, которые ждут чего-либо от Думы, как на того человека, который, по шутке какого0то древнего мудреца, подставляет решето под доимого другим человеком козла» (письмо И.М. Трегубову.см. Т. 79).
11 мая.
Чтение вслух отрывков из «Записок из Мертвого дома» Достоевского «Орел» и «Смерть в госпитале», помещенных в «Круге чтения».

Газета «Русские ведомости» (1909. № 107) сообщила о том, что по решению Петербургской судебной палаты Н.Е. Фельтен приговорен к заключению в крепости на 6 месяцев за издание брошюр Толстого «Не убий», «Письмо либералам», «Христианство и патриотизм».

12 мая.
Толстой об ожидании встречи с И.И. Мечниковым и его женой: «Приезжает ... интересный для меня Мечников, к посещению которого готовлюсь, чтобы не оскорбить его неуважением к его деятельности, на которую он посвятил свою жизнь и которую считает очень важной».(из письма В.Г. Черткову)
Приезд корреспондента «Русского слова» С. П. Спиро с целью интервьюировать Толстого о посещении его Мечниковым (С. П. Спиро. «Беседы с Л. Н. Толстим». - М., 1910).

Лев Николаевич в дневнике набросал конспект письма жене Софьей Андреевне, которое было бы передано ей после его смерти: «Прости меня. Я же простил тебе, но не могу не сказать, хоть из-за гроба, того, чего не решался сказать живой, чтобы не раздражать и потому не успеть и даже навсегда не успеть помочь тебе, не решался сказать, что ты живешь дурно, для себя дурно, мучая себя и других и лишая себя лучшего блага — любви. А ты способна — и очень — ко всему самому лучшему».

13 мая. Запись в Дневнике о жене: «За завтраком С. Была ужасна. Оказывается, она читала повесть «Дьявол», и в ней поднялись старые дрожжи, и мне было очень тяжело».

18 мая.
Чтение «глупой» статьи П.Б. Струве «На разные темы» в журнале «Русская мысль» (майский №. - С. 113-126), посвященной вышедшему тому переписки А.И. Эртеля, в которой автор попутно говорит о Толстом — о его «догматической морали».
19 мая. Работа над письмо к русскому эмигранту в Америке Д. Севиту о религиозном воспитании.

20 мая. Толстой рассказал сотруднику газеты «Русское слово» С. Спиро содержание своей статьи о «Вехах» и продиктовал выдержки из нее. Корреспонденция была напечана в газете (№ 114 за 21 мая 1909 года).
В «Русском слове» Толстой прочитал заметку В. Кругляка «Рузвельт о Толстом» по поводу статьи Теодора Рузвельта «Толстой».

21 мая. Л.Н. просматривает только что полученную газету «Русское слово», в которой должен появиться его разговор о «Вехах» с бывшим вчера интервьюером (С.П. Спиро. Л.Н. Толстой о «Вехах». // Русское слово. 1909. № 114, 21 мая) и говорит, что эта газета расходится в 150 000 экземпляров, каждый номер читает по несколько человек. Удивительная сила!
